Christian Bouriez and Montanelle Beeher, B.V. (collectively referred to as "Bouriez") appeal the District Courts grant of summary judgment in favor of Carnegie Mellon University ("CMU") with respect to Bouriezs fraudulent misrepresentation and negligent misrepresentation claims. The issue on appeal is whether the District Court erred in concluding that Bouriez failed to establish that CMU proximately caused Bouriezs losses. Because we conclude that the District Courts proximate cause analysis was in error, we will vacate the grant of summary judgment to CMU and remand for further proceedings consistent with this opinion.
